Vaping Regulations in Australia

The National Regulatory Framework

Official Australian Government public information session on the vaping reforms, published by the Therapeutic Goods Administration (TGA).

Since 2024, Australia has progressively tightened the rules around vaping products through reforms to the Therapeutic Goods Act. These changes affect how vaping products can be imported, supplied, sold, and advertised across the country.

Pharmacy-Only Access Model

Nicotine vaping products are generally only available through pharmacies. Depending on the product and strength, this may require a prescription or can be accessed following a pharmacist consultation under specific conditions set by the TGA.

Who Can Legally Supply Vaping Products

General retailers, convenience stores, and online marketplaces are not permitted to sell nicotine vaping products. Supply is restricted to registered pharmacies operating within the legal framework.

Age Verification Requirements

Pharmacies supplying vaping products must verify that purchasers are 18 years or older, consistent with broader tobacco and nicotine control laws.

Nicotine vs Non-Nicotine Products

While nicotine vaping products sit within the pharmacy-only model, non-nicotine vaping products are also subject to restrictions in many states and territories, including limits on retail sale and advertising. Rules vary by jurisdiction, so state-based advice should always be checked.

Advertising & Promotion Restrictions

Advertising, promoting, or marketing vaping products — including online, in print, and in-store — is heavily restricted under Australian law. This applies regardless of whether nicotine is present and regardless of the platform used.

Importation Rules

Personal importation of vaping products is subject to strict conditions, including quantity limits and documentation requirements. Importing outside these conditions can result in products being seized by the Australian Border Force.

Penalties for Non-Compliance

Scales of justice representing vaping law and regulation

Breaching vaping regulations can result in substantial civil penalties and, for serious or repeated breaches, criminal charges. Both individuals and businesses can be held liable.

State and Territory Variations

While the TGA reforms set the national framework, individual states and territories retain their own tobacco and vaping control laws, which can add extra restrictions on top of the federal rules.

Retail and Display Restrictions

Most states restrict how tobacco and vaping products can be displayed in stores that are licensed to sell them, generally requiring products to be out of public view.

Smoke-Free Area Laws

Vaping is generally banned anywhere smoking is banned, including enclosed public spaces, near building entrances, and in some outdoor areas. These smoke-free zone rules differ by state and local council.

Local Licensing Requirements

Some states require specific licensing or notification for businesses that handle tobacco and vaping products, separate from the federal therapeutic goods framework.
